Insurance Litigation
The Firm invites referrals involving
the prosecution or defense of insurance-related matters,
including the following areas:
- First party coverages, such as homeowner’s
insurance, personal automobile insurance, life insurance,
and health insurance,
- Third party coverages, such as commercial general
liability policies, workers’ compensation policies,
professional liability policies, director’s and
officer’s liability, and surety insurance,
- Bad faith claim handling,
- Insurance fraud,
- Damages resulting from negligent misrepresentation
and intentional infliction of emotional distress,
- Excess insurance issues and coverages,
- Subrogation claims against insurance companies,
- Breach of fiduciary duty, and
- Duty to defend issues.
The Firm has represented corporate clients and
will accept referrals of corporate clients that have claims
against insurance companies, either potential or current.
Referrals are particularly appropriate if the referring
firm has a conflict between its corporate clients and
its insurance company clients. Our attorneys will review
reservation of rights letters from insurance companies,
and draft responses thereto. When insurance companies
have issued a reservation of rights letter, it is often
appropriate for a corporate client to retain independent
counsel, which the firm is available to provide.
Should
declaratory relief be necessary, the Firm is prepared to file the necessary action,
in State or Federal Court, conduct the appropriate discovery, and
resolve, through settlement or litigation, the issues
involved.
The Firm has access to and has retained experts
in coverage and bad faith actions, and is experienced
in the use and limitations of experts in insurance
litigation.
